Welcome to Swyft ("we," "us," or "our"). By accessing or using our website, services, applications, and content (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

These Terms of Service constitute a legally binding agreement between you and Swyft regarding your use of the Services. Our Privacy Policy, which is incorporated by reference, explains how we collect and use your information.

2. Description of Services

Swyft is a decentralized wallet reputation system on the Solana blockchain. Our Services include but are not limited to:

Providing reputation scores for Solana blockchain wallets
Enabling users to submit vouches and reviews for wallets
Categorizing wallets based on trading behavior and community feedback
Allowing users to create and manage profiles linked to their wallet addresses
Displaying on-chain activity and community-driven assessments

3. User Registration and Accounts

To access certain features of our Services, you may need to connect your Solana wallet. By connecting your wallet, you agree to provide accurate, current, and complete information, and to maintain and update this information.

You are responsible for maintaining the confidentiality of your wallet credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

4. User Content and Conduct

Our Services allow users to submit content, including but not limited to vouches, reviews, profile information, and comments ("User Content"). You retain ownership rights to your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content.

You agree not to submit User Content that:

Is false, misleading, or fraudulent
Is defamatory, obscene, pornographic, vulgar, or offensive
Promotes discrimination, bigotry, racism, hatred, harassment, or harm
Violates the privacy or publicity rights of others
Infringes intellectual property or other proprietary rights
Constitutes spam, phishing, or unsolicited commercial content
Contains malware, spyware, viruses, or other harmful code

We reserve the right to remove User Content at our discretion, with or without notice, for any reason or no reason, including if we determine it violates these Terms.

5. Reputation System and Vouching

Swyft's reputation system is based on user-submitted vouches and reviews. While we strive to maintain the integrity of this system, we make no guarantees regarding the accuracy, reliability, or completeness of reputation scores, reviews, or categorizations.

By submitting a vouch or review, you confirm that it represents your honest assessment based on your direct experience or knowledge. Submitting false vouches, engaging in coordinated attacks on wallets, or manipulating the reputation system in any way is prohibited.

Our algorithms automatically calculate reputation scores based on submitted vouches and other factors. We reserve the right to adjust these algorithms at any time.

6. $SWYFT Token

The $SWYFT token is a utility token on the Solana blockchain. Holding $SWYFT does not confer ownership rights in Swyft, voting rights, or any entitlement to dividends or other financial returns.

The value of $SWYFT may be volatile, and we make no guarantees regarding its future value. You acknowledge the inherent risks in cryptocurrency and token ownership, including the possibility of complete loss of value.

7. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof, are owned by Swyft or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent. You also may not reverse engineer or attempt to extract the source code of our software.

8. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT WILL SWYFT, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

You agree to defend, indemnify, and hold harmless Swyft, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

10. Modification of Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Cayman Islands, without giving effect to any principles of conflicts of law. Any dispute arising from or relating to these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce.

We reserve the right to terminate or suspend your access to all or part of the Services, with or without notice, for any reason or no reason, including if we reasonably believe you have violated these Terms.
